Judge Galen has opened a Pandora's Box of difficulties by her incomplete action. This incomplete action is best explained by Zeus' lawyer, Jennifer Dietz’s “No Hoorays for the judge” found on the next page:
Basically, the problems created by not vacating all the charges under the statute found by Judge Galen as being unconstitutional continue:
The Court has ordered Obedience Training for Zeus and the Oteros and only given them 14-days to arrange for all the requirements attached to their concept of a "dangerous dog" to be put in place. Not just any dog trainer will be able to adequately give the proper training. It will take someone experienced with the instinctual behavior of, and who specializes in, the training of German Shepherd Dogs to be effective in this training. Unless someone is found in their location (and is generous) the cost of this additional expense will tax their limited income. It is also my understanding that the Oteros do not presently have transportation to get them to a dog training facility.
I am sure that Sarasota Animal Services is available if the Oteros fail to meet their “dangerous dog” requirements. Florida Statute 767.12 Section 7 provides “Any person who violates any provision of this section is guilty of a non criminal infraction, punishable by a fine not exceeding $500”.
Poor Zeus spent 130 days at the Sarasota Animal Service in isolation while the charge was legally sorted out. That is $1300.00 they collected for their “unconstitutional” act. The owners were not allowed to see him during that time. Talk about cruel and unusual punishment for a 2-year old GSD! Remember, a 2-year old GSD is mentally just a baby despite their grown size. Judge Galen has put the Oteros between a "rock and a hard place" with her judgment. I agree with Attorney Jennifer Dietz evaluation of what Judge Galen has done.
